  • “Account” means the personalised account created by a User on the Website, if applicable, requiring a valid email address and a secure password. Aleeya reserves the right to suspend or terminate an Account at any time, with or without cause, subject to the provisions outlined in Section 3. Use of the Website & Services. Responsibility for maintaining the confidentiality of Account login credentials rests solely with the User.
  • “Content” means any and all text, graphics, images, videos, software, audio, data, and other materials, whether visually perceptible or not, available on the Website, including but not limited to product descriptions, promotional materials, user-generated content (if permitted), and any information submitted by Aleeya. Content may be subject to copyright, trademark, and other intellectual property rights, as detailed in Section 4. Intellectual Property. Aleeya does not warrant the accuracy, completeness, or timeliness of Content provided by third parties.
  • “Intellectual Property” means all trademarks, service marks, trade names, logos, copyrights, patents, trade secrets, design rights, database rights, and other intellectual property rights, whether registered or unregistered, owned or licensed by Aleeya or its affiliates. Nothing contained within these Terms shall be construed as granting any license or right to use any of Aleeya’s Intellectual Property without express written consent. Any unauthorised use of Intellectual Property is strictly prohibited and may result in legal action.
  • “Personal Data” means any information relating to an identified or identifiable natural person (“data subject”), as defined by applicable data protection legislation, including but not limited to the General Data Protection Regulation (GDPR), the Australian Privacy Principles (APP), and any subsequent amendments. Personal Data includes, but is not limited to, name, email address, postal address, phone number, payment information, and browsing behaviour. Aleeya’s collection, use, and protection of Personal Data are governed by our Privacy Policy.
  • “Services” means collectively, the Website and all associated functionalities, features, content, and services offered by Aleeya, including but not limited to access to Content, Account creation (if applicable), and any customer support services provided.
  • “User” means any individual, entity, company, or organisation accessing or using the Services, regardless of whether they have created an Account. By accessing or using the Services, the User agrees to be bound by these Terms. Users are responsible for their own conduct and any consequences arising from their use of the Services.
  • “Website” means the online platform located at aleeya.au including all pages, features, and functionalities thereof, operated by Aleeya.

  • Engage in any activity that violates any applicable law, regulation, or legal process. This includes, but is not limited to, laws relating to intellectual property, data protection, consumer protection, and fraud.
  • Upload, transmit, post, email, or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, pornographic, invasive of privacy, or otherwise objectionable. Content must be respectful of others and comply with community standards.
  • Attempt to gain unauthorised access to any part of the Website, any systems or networks connected to the Website, or any user accounts. This includes, but is not limited to, hacking, cracking, or bypassing security measures.

3.4. Account Deletion & Suspension: Aleeya reserves the right, at its sole discretion, to suspend, restrict, or delete user accounts, with or without cause and without prior notice. This includes, but is not limited to, situations where a user violates these Terms of Service, engages in suspicious activity, or when such action is deemed necessary to protect the integrity of the Website, the Services, or other users. Aleeya is under no obligation to provide detailed explanations or justifications for account deletion or suspension, and no compensation will be provided for any loss of data or access resulting from such action. This right is essential to allow us to operate the website in a manner that aligns with our business practices and ensures a safe and positive experience for all users.

 

4. Intellectual Property

4.1. Ownership & Scope: All Content on the Website, including but not limited to text, graphics, images, logos, icons, audio, video, software, design elements, code, structure, and arrangement (collectively “Content”), is owned by Aleeya, its affiliates, or its licensors and is protected by Australian and international Intellectual Property laws, including but not limited to copyright, trademark, patent, and trade secret laws. This protection extends to all derivative works created from the Content. Aleeya retains all right, title, and interest in and to the Content, and all associated Intellectual Property rights. Any unauthorised use, reproduction, distribution, or modification of the Content is strictly prohibited and constitutes a violation of applicable law. K&K Aus, as a related entity, shares in and benefits from the enforcement of these Intellectual Property rights.

4.2. Limited Licence & Restrictions: Subject to your full compliance with these Terms, Aleeya grants you a non-exclusive, non-transferable, revocable, and limited licence to access and use the Content solely for your personal, non-commercial purposes. This licence does not grant you any ownership rights in the Content. You may not:

  • Reproduce, distribute, modify, create derivative works from, or publicly display or perform the Content without Aleeya’s prior written consent.
  • Remove any copyright, trademark, or other proprietary notices from the Content.
  • Use the Content in any manner that is defamatory, obscene, or otherwise unlawful.
  • Use the Content for any commercial purpose, including but not limited to advertising, marketing, or sales, without a separate agreement with Aleeya.
  • Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of any software underlying the Website or the Content.
  • Circumvent any technological measures implemented to protect the Content.

This licence is automatically terminated upon your violation of these Terms.

4.3. User-Generated Content & Rights Grant: If you submit any content to the Website (e.g., reviews, comments, images, videos, or other materials) (hereinafter “User Content”), you hereby grant to Aleeya, and its affiliates, a non-exclusive, royalty-free, perpetual, irrevocable, worldwide, transferable right and licence to use, reproduce, modify, adapt, publish, translate, distribute, transmit, display, perform, and create derivative works from such User Content, in any media now known or hereafter devised, for any purpose whatsoever, including but not limited to commercial purposes.

You warrant and represent that:

  • You are the sole owner of the User Content, or have all necessary rights and permissions to submit it.

  • The User Content does not infringe upon the Intellectual Property rights, privacy rights, or any other rights of any third party.

  • The User Content is accurate, complete, and not misleading.

  • You are responsible for all User Content you submit and for any claims arising from its use.

By submitting User Content, you waive any moral rights you may have in such content. Aleeya reserves the right to remove or modify any User Content that violates these Terms or is otherwise objectionable.

4.4. Social Media Content & Harvesting Rights: Aleeya reserves the right to collect, monitor, and utilise publicly available content relating to Aleeya, its products, services, and brand from all social media platforms, including, but not limited to, Facebook, Instagram, X (formerly Twitter), LinkedIn, YouTube, TikTok, and any future platforms. This right extends to the collection of text, images, videos, hashtags, comments, and any other publicly accessible content. By utilising these platforms and posting content related to Aleeya, you expressly consent to Aleeya’s collection and use of your content, even if you are not a direct contributor to the Aleeya Website.

Specifically, Aleeya shall have the right to:

  • Harvest and Aggregate Content: Collect content mentioning or referencing Aleeya, its brands, products, or services, utilising automated tools and manual monitoring.
  • Repurpose & Adapt Content: Modify, adapt, edit, re-format, and create derivative works from the harvested social media content.
  • Commercial Exploitation: Use the harvested content for commercial purposes, including, but not limited to, advertising, marketing campaigns, promotional materials, website content, social media posting, and inclusion in sales presentations.
  • Attribution (or Lack Thereof): While Aleeya may, at its discretion, provide attribution to the original source of social media content, it is not obligated to do so. The use of social media content does not imply endorsement, sponsorship, or affiliation by the original content creator.
  • Data Analysis & Insights: Analyse the harvested content to gain insights into customer sentiment, brand perception, and market trends.
  • Legal Transfer: This right is fully transferable to Aleeya’s affiliates, subsidiaries, and any third-party partners engaged by Aleeya for marketing or promotional purposes.

You acknowledge that social media platforms have their own terms of service and privacy policies, and that Aleeya is not responsible for those policies. By posting content related to Aleeya on social media, you represent and warrant that you have the right to grant Aleeya the rights outlined herein.

4.5. Copyright & Intellectual Property: All content on the Website, including, but not limited to, text, graphics, images, videos, logos, and software, is the property of Aleeya or its licensors and is protected by copyright, trademark, patent, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, or exploit any content on the Website without Aleeya’s prior written consent. Any unauthorised use of the content may result in legal action. Aleeya respects the intellectual property rights of others and will respond to legitimate claims of copyright infringement in accordance with applicable law.

 

5. Disclaimers and Limitations of Liability

5.1.   • Data Collected: Turnstile collects data about the user’s browser, operating system, and network connection to assess the likelihood of the user being a human. It does not track user behaviour across websites. It relies on cryptographic tokens and does not require the user to share any personally identifiable information.
  • Data Processing: The data collected is processed by Cloudflare to verify the user’s humanity.
  • Data Sharing: We share limited browser and network data with Cloudflare for verification purposes.

7.4 Hosting Provider

  • Purpose: Our Website is hosted on servers located Australia. We select our hosting provider based on security, reliability, and performance.

  • Data Processing: Our hosting provider processes the data in accordance with their privacy policy and security practices.

We reserve the right to modify prices or discontinue products at any time, although changes will not affect orders that have already been confirmed. Payment is processed in Australian Dollars (AUD)] unless otherwise stated. We currently accept payments via Square, supporting major credit and debit cards as accepted by the Square payment gateway. By submitting your payment information, you represent and warrant that you have the legal right to use the payment method and that the billing information provided is accurate and complete. We do not offer credit terms or invoice payment options at this time.

8.2. Refund Policy

At Aleeya, customer satisfaction is paramount. We strive to provide high-quality products and services, however, we understand that circumstances may arise where a refund is requested. Our refund policy is outlined below, taking into consideration the nature of the product or service purchased. Please read this section carefully.

  • Physical Products (e.g., Merchandise): For physical products, we accept returns within 14 days of delivery, provided the item is unused, unopened (where applicable), and in its original packaging. The customer is responsible for the cost of return shipping, unless the item is defective or we have made an error in the order. Upon receipt of the returned item and verification of its condition, we will issue a full refund for the purchase price, excluding original shipping costs.
  • Services (e.g., Consultations, Workshops): Refund eligibility for services depends on the timing of the cancellation request:
    • Cancellation more than 7 days before the scheduled service: A full refund will be issued.
    • Cancellation between 7 days and 24 hours before the scheduled service: A 50% refund will be issued.
    • Cancellation within 24 hours of the scheduled service or no-show: No refund will be issued.
  • Sale Items: Sale items are final sale and are not eligible for refunds or exchanges, unless the item is defective.
  • Damaged or Defective Items: If you receive a damaged or defective item, please contact us within 7 days of delivery with photographic evidence of the damage or defect. We will either replace the item (if available) or issue a full refund, including return shipping costs.

However, no method of transmission over the internet is completely secure. Therefore, we cannot guarantee the absolute security of your data. You acknowledge and agree that we are not liable for any loss or damage arising from unauthorised access to or use of your payment information. 8.4. Disputes and Chargebacks

In the event of a dispute, we will first attempt to resolve the matter through good faith negotiation. If a negotiated resolution cannot be reached within thirty (30) days, either party may initiate mediation.

Mediation will be conducted by a qualified and impartial mediator mutually agreed upon by both parties. The mediation will take place in Melbourne, Victoria, Australia, or via a mutually agreed-upon virtual platform. The cost of mediation will be shared equally between the parties.

Both parties agree to participate in mediation in good faith and to make reasonable efforts to reach a mutually acceptable resolution. If mediation is unsuccessful, either party may pursue legal remedies in accordance with applicable law.

 

11. Amendments

Aleeya reserves the right to amend these Terms of Service at any time. We will post any changes to these Terms on the Website, along with the date of the latest revision.
